Photo Session Terms and Conditions

Booking and payment of the session retainer fee to Three Red Ponies – Michelle Wrighton Photography (“The Photographer”) signifies you have read, understand and accept these Terms and Conditions.


Copyright of all images remains the sole property of The Photographer under the 1988 Copyright Act.

The Photographer retains the right to display and use images online and in print for marketing, publicity, competition, advertising or other purposes.

Online Gallery

Final images of each horse will be displayed for viewing and purchase in a private gallery that will be available for five days.

The special Group Day pricing for printed products is available for the first 48 hours only, after which it will revert to normal pricing.

Client or Third Party Alterations

Images or part of an image cannot be edited, altered, copied or saved by any device or other means without express written permission from The Photographer.

This includes cropping or removing the watermark from web use digital files and copying or saving by screenshot any photograph from the online gallery.

Number of Final Photographs

This may vary according to subject compliance and behaviour. All images that meet The Photographer’s strict quality control will be added to your online gallery, usually this is a minimum of 10 and up to 20 images for 45 minute group sessions.

Photograph Editing

Photographs may not be edited by anyone other than The Photographer without express written permission. Removal of the small logo watermark is expressly forbidden.

Online gallery images and web size digital files will receive basic editing for colour correction, exposure, contrast, sharpness and brightness.

Additional editing such as ear swaps, blemish removal and lead or rein removal is included on purchased printed products only.

Extensive photoshop work including composites and background changes is charged at $95/hour.

Delivery - Digital files

Digital files are optimised for web viewing and delivered as electronic downloads that can be accessed immediately once they have been ordered.

Delivery - Printed Products

As Printed Products are all custom made, please allow 6-8 weeks for delivery depending on the products ordered.

There is a fixed post and packaging fee of $15 per order for prints and art products which will be shipped by registered Australia Post. Large orders may be delivered in person or by courier.

When ordering rolled photographic prints, it is highly recommended that you take them straight to your framer for careful removal from the shipping tube to avoid damage and for archival mounting and framing to protect your artwork.

In the unlikely event the mailing tube is damaged during shipping, please provide photos of the unopened mailing tube clearly showing the damage to arrange replacement.

Cancellation - Within Service Area

A full refund is available up to 7 days before the session date.

Refunds are un-available for bookings cancelled less than 7 days before the session date unless a replacement booking can be found.

Cancellation - Outside of Service Area

A refund less any travel or accommodation fees incurred by The Photographer is available up to 14 days before the session date.

Refunds are un-available for bookings cancelled less than 14 days before the session date unless a replacement booking can be found.

Limit of Liability

The Photographer is fully insured for Public Liability and Professional Indemnity and takes all reasonable precautions to ensure back-up of photographic files from sessions.

In the event of illness, sickness, accident or other event that results in partial or total photographic failure, the full extent of liability is limited to either a refund of monies paid or a re-shoot at a mutually agreed time.
