Booking and payment of the session retainer fee to Three Red Ponies/Michelle Wrighton (“The Photographer”) signifies you have read, understand and accept these Terms and Conditions.
Copyright
Copyright of all images remains the sole property of The Photographer under the 1988 Copyright Act.
The Photographer retains the right to display and use images online and in print for marketing, publicity, competition, advertising or other purposes.
Client or Third Party Alterations
Images or part of an image cannot be edited, altered, copied or saved by any device or other means without express written permission from The Photographer.
This includes cropping or removing the watermark from web use digital files and copying or saving by screenshot any photograph from displayed online. gallery.
Number of Final Photographs
This may vary according to subject compliance and behaviour. All images that meet The Photographer’s strict quality control will be available for the client to make final purchase selection from. Typically this is a minimum of 20 images for studio sessions and 40-50 for lifestyle (outdoor) sessions.
Photograph Editing
Photographs may not be edited by anyone other than The Photographer without express written permission. Removal of the small logo watermark is expressly forbidden.
Images shown at the Ordering Appointment will receive basic editing for colour correction, exposure, contrast, sharpness and brightness.
Additional editing such as ear swaps, blemish removal and lead or rein removal is included on purchased printed products only.
Extensive photoshop work including composites and background changes is charged at $95/hour.
Delivery – Digital files
Purchased digital files are optimised for web viewing and delivered as electronic downloads. Matching digital files are provided complimentary with printed artwork at the same size as purchased.
Delivery – Printed Products
As Printed Products are all custom made, please allow 6-8 weeks for completion depending on the products ordered.
Collection will be available from The Photographers studio in Boyup Brook, unless other arrangements are made for delivery (fees may apply).
Printing from Digital Files
Due to technical differences between equipment, inks and printing machines between different photo labs that will impact colour tones, brightness, contrast, depth and overall quality of the final printed image, The Photographer is unable to guarantee the quality of prints or products unless they have been purchased directly through The Photographers using The Photographers trusted professional print labs.
Re-schedule or Cancellation – Within Service Area
Sessions can be re-scheduled to another date without penalty. A full refund is available up to 7 days before the session date.
Refunds are un-available for bookings cancelled less than 7 days before the session date unless a replacement booking can be found.
Re-schedule or Cancellation – Outside of Service Area
Sessions can be re-scheduled to another date without penalty, with the exception of any Accommodation or travel expenses already incurred by The photographer. A refund less any travel or accommodation fees incurred by The Photographer is available up to 14 days before the session date.
Refunds are not available for bookings cancelled less than 14 days before the session date unless a replacement booking can be found.
Limit of Liability
The Photographer is fully insured for Public Liability and takes all reasonable precautions to ensure back-up of photographic files from sessions.
In the event of illness, sickness, accident or other event that results in partial or total photographic failure, the full extent of liability is limited to either a refund of monies paid or a re-shoot at a mutually agreed time.
Agreement and Acceptance of Terms and Conditions
Payment of the Session Retainer by The Client signifies The Client had read, understood, agrees and accepts these Terms and Conditions.
